Welcome to AI Baby, developed by Joinim Apps (a product of AKATRO BİLİŞİM ANONİM ŞİRKETİ) ("we," "our," or "us"). By accessing or using the platform, website, mobile application, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

5. AI Baby Generation Service

The AI baby generation feature uses artificial intelligence to create predicted baby images based on uploaded parent photos. You understand and acknowledge that:

• Generated images are AI predictions and do not represent actual future outcomes
• The accuracy of generated images is not guaranteed
• You must have the right to upload any photos you submit
• You must not upload photos of minors without parental consent
• Generated images are for entertainment purposes only

6. Intellectual Property Rights

The Services, including all content, features, and functionality, are owned by the company and are protected by copyright, trademark, patent, and other intellectual property laws.

A limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal purposes is granted to users.

7. User Content

The Services may allow you to submit content, including photos and other materials ("User Content"). You retain all rights to your User Content.

By submitting User Content, you grant the company a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Content in connection with providing the Services.

You represent and warrant that your User Content does not violate any third-party rights and complies with all applicable laws.

8. Prohibited Conduct

You agree not to use the Services to:

• Violate any applicable law or regulation
• Upload photos of individuals without their consent
• Generate inappropriate, offensive, or harmful content
• Infringe upon the rights of others
• Attempt to gain unauthorized access to the systems
• Use the Services for any illegal or unauthorized purpose
• Transmit any viruses, malware, or other harmful code
• Collect data about other users without their consent

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES.

The Services are provided "as is" and "as available" without warranties of any kind. AI-generated baby images are for entertainment purposes only and should not be relied upon for any medical, genetic, or predictive purposes.

11. Indemnification

You agree to indemnify and hold harmless the company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

12. Term and Termination

The company may terminate or suspend your access to the Services immediately, without notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

13. Modifications to the Terms

The company reserves the right to modify these Terms at any time. Material changes will be communicated via email or website notice. Your continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.

15. Dispute Resolution

Any dispute arising out of these Terms shall be referred to and finally resolved by arbitration under the applicable rules of Turkish law. The seat of arbitration shall be Antalya, Türkiye. The language of arbitral proceedings shall be English.
